w- P" " LOUIS GREGORIS and MARY GREGORIS, his wife, the first parti es, hereby Orant to__CITY OF SAN LEANDRO, a YiuniciPal Coloration, the second part y , all that real property situated in the City of San Leandro, as follows: County of Alameda, State of California, described PORTION of the land described in the deed by jmerican Trust Company to Louis Gregoris and Mary Gregoris dated October 27, 1939 and recorded November 9, 1939 in book 3846 of Official Records of Alameda County at page 90, described as follows: CuMMENCING at the intersection of the eastern line of Franklin Lane, as said lane is shown on the "Map of Franklin Subdivision, San Leandro, California", filed May 3, 1927, in book 12 of Naps at page 71, in the of- fice of the County Recorder of Alameda County, with the northeastern line of the right of way, 80 feet wide, of tree western Pacific Railway Company; and running thence along said right of way line south 430 491 30" east 310.28 feet to the actual point of beginning for this description; and continuing thence along said right of way line south 430 49, 301, east 420.60 feet to the southeastern line of the land described in the deed above mentioned; thence along the last named line norta 770 18' east 6L84 feet to the northeastern line of tiie land described in said deed; thence along the last named line north 300 58' 30" west 106.27 feet to a line drawn parallel with and distant at right angles 80 feet northeasterly from the north- eastern line of said right of way of the Western Pacific Railway Company; thence along the line so drawn north 430 49, 301, west 388.71 feet to the eastern line of the parcel of land secondly described in the deed by Louis ;;regoris and Mary Gregoris to Clarence A. The grantors understand that the present intention of the grantee of the lands hereby conveyed in fee is to construct and maintain thereon a highway. The grantors hereby waive any claim for any and all damages to any other real property owned by the grantors, contiguous to the lands hereby conveyed, by reason of the location, construction or maintenance of said highway.
