BOOY,7778 MH528 <br />i <br />r <br />P <br />'4 <br />Agreement made this day of 1955, between <br />INTERBAY jLV.6LUPiVILiiT CO. a corporation, <br />hereinafter referred to as Grantor, and the City of San Leandro, a <br />municipal corporation, hereinafter referred to as Grantee. <br />RECITALS <br />Grantor is the owner of certain land in the City of San Leandro, <br />Alameda County, California, and delineated on the plat attached hereto <br />and designated as Number ( / ) thereon. <br />Gra^tee has accepted certain public streets in the immediate <br />neighborhood of the said lands of the Grantor. Grantee operates cer- <br />tain ditches for the purpose of conducting drainage waters from the <br />aforesaid public streets. Under flood conditions said ditches may <br />over -flow onto lands of Grantor and others <br />Grantor has agreed, in consideration of a valuable consideration <br />paid by Grantee, the receipt of which by the Grantor is hereby acknm l- <br />edged, to grant to the Grantee an easement or license for over -flow <br />from said ditch to flow and remain upon the property of GrantM <br />Now, this Indenture witnesseth that for the consideration aforesaid, <br />paid by Grantee to Grantor, the Grantor hereby grants unto the Grantee <br />the right for waters over -flowing from the aforesaid ditch to be and <br />remain upon the lands of Grantor as delineated and designated upon the <br />map hereunto attached. <br />This grant shall automatically expire and become null and void <br />upon completion and acceptance of adequate drainage facilities in the <br />neighborhood to properly care for flood waters accumulating upon the <br />streets of Grantee in the neighborhood of this grant. _ <br />In Witness Whereof, the parties hereunto have caused this agreement <br />to be executed by their respective officers thereunto duly authorized, <br />the day and year first hereinabove written, <br />LiPQA1 �e &N�,oyac zaLai /1CT_ <br />By <br />By Q <br />CITY OF SAN LEANDRO, a municipal corporation <br />Mayor Ll <br />
