BOOY,7778 MH528 i r P '4 Agreement made this day of 1955, between INTERBAY jLV.6LUPiVILiiT CO. a corporation, hereinafter referred to as Grantor, and the City of San Leandro, a municipal corporation, hereinafter referred to as Grantee. RECITALS Grantor is the owner of certain land in the City of San Leandro, Alameda County, California, and delineated on the plat attached hereto and designated as Number ( / ) thereon. Gra^tee has accepted certain public streets in the immediate neighborhood of the said lands of the Grantor. Grantee operates cer- tain ditches for the purpose of conducting drainage waters from the aforesaid public streets. Under flood conditions said ditches may over -flow onto lands of Grantor and others Grantor has agreed, in consideration of a valuable consideration paid by Grantee, the receipt of which by the Grantor is hereby acknm l- edged, to grant to the Grantee an easement or license for over -flow from said ditch to flow and remain upon the property of GrantM Now, this Indenture witnesseth that for the consideration aforesaid, paid by Grantee to Grantor, the Grantor hereby grants unto the Grantee the right for waters over -flowing from the aforesaid ditch to be and remain upon the lands of Grantor as delineated and designated upon the map hereunto attached.
