SURETY BM <br />P,NOVI ALL TTN BY THESE PRESENTS <br />That ive9 --- -- — <br />as principal, and <br />a corporation, as surety, are held and firmly bound Tinto the <br />SOUTHERN PACIFIC CO":'PANY, a corporation, hereinafter called "Company," <br />in the surr_ of ) <br />Dollars, lawful money of The United States of America, for the pay- <br />ment of which well and truly to be made, we bind ourselves, our heirs, <br />executors, administrators and successors, jointly and severally, <br />firmly by these presents. <br />SEALED with our seals and dated this day of <br />9 19 <br />THE CONDITION of the above obligation is such that, <br />WHEREAS, on the day of 9 19 , the <br />above named rrincipal entered into a certain agreement in writing <br />which is hereto annexed, with said Company relating to installation <br />of two (2) 21 inch A.T.S.M.-C-76-1+1 extra strength concrete sewer <br />pipes encased in a 60 inch corrugated culvert, for the City of San <br />Leandro, at Mulford, Alameda County, California. <br />WHEREAS, said agreement provides that the said principal <br />will furnish to said Company a bond in the aforesaid sum in form <br />and with good and sufficient surety to be approved by said Company, <br />conditioned that the said principal will well and truly perform all <br />covenants, conditions and stipulations on principal's part to be <br />performed as set forth in said agreement. <br />NO01, THEREFORE, if the above bounden principal shall faith- <br />fully perform said agreement according to its tern s, covenants and <br />conditions, then this obligation shall be void; other,!rise to remain <br />in full force and effect. <br />It is mutually agreed and made a condition hereof that any <br />change in the nature, intent or method of performance of said <br />agreement that may be made, and any change of any nature whatsoever <br />that may be made in the terrn.s of said agreement by contract between <br />-1- <br />
