INDENTURE <br />MONADNOCK MILLS, a New Hampshire corporation, as Grantor, <br />x in consideration of the sum of Three Thousand Dollars ($3,000), <br />receipt of which is hereby acknowledged, hereby grants, transfers <br />and sets over to the City of San Leandro, a municipal corporation <br />organized and existing under the Constitution and laws of the State <br />of California, its successors and assigns, as Grantee, an unob- <br />structed, perpetual easement and right of way to establish, con- <br />I� struct and maintain for all time, a public sewer in, through, on <br />and along that certain real property situate in the City of San <br />�._ Leandro, County of Alameda, State of California, described as <br />g follows: ` 37 <br />BEGINNING at a point on the southeastern line of <br />West Avenue 132, known as Wicks Landing Road, distant <br />thereon north 620 east 1380.62 feet from the north- <br />eastern line of the right of way of the Southern <br />•• Pacific Company, as said northeastern line exists since <br />March 10, 1944; running thence along said line of West <br />Avenue 132 north 620 east 10 feet; thence south 28o east <br />°°{ 993.66 feet to the southeastern line of the 42 acre <br />{ tract of land described in the deed by the Roman Catholic <br />- Arch Bishop of San Francisco to C. Dudley DeVelbiss, et <br />al., dated September 5, 1945, recorded December 4, 1945 <br />in book 4810 of Official Records of Alameda County, page <br />239 (SS/80869); thence along the last named line south <br />620 west 10 feet; thence north 280 west 993.66 feet to <br />the point of beginning. <br />To have and to hold unto Grantee forever, with right <br />of ingress and egress to inspect, repair and maintain a public <br />sewer and appurtenances thereon, and for no other purpose. Pro- <br />vided that if said sewer shall not have been constructed and <br />placed in operation within five (5) years next following the date <br />of this indenture, the easement and right of way herein granted <br />may be terminated at the option of the Grantor; and provided fur- <br />ther that if said easement and right of way, or any part thereof', <br />shall at any time cease to be used for the purposes of a public <br />sewer as herein stated continuously for a period of five (5) <br />years, said easement and right of way may, at the option of the <br />Grantor, be terminated as to any part or all of said easement <br />and right of way not so used. <br />IN WITNESS WHEREOF, said MONADNOCK MILLS has executed <br />these presents this 1st day of may 1951. <br />476 11 <br />RECORDED at REQUEST OF <br />OAKLAND TITLE INSURANCE <br />AND GUARANTY COWANY <br />AT &&M A.
