INDENTURE MONADNOCK MILLS, a New Hampshire corporation, as Grantor, x in consideration of the sum of Three Thousand Dollars ($3,000), receipt of which is hereby acknowledged, hereby grants, transfers and sets over to the City of San Leandro, a municipal corporation organized and existing under the Constitution and laws of the State of California, its successors and assigns, as Grantee, an unob- structed, perpetual easement and right of way to establish, con- I� struct and maintain for all time, a public sewer in, through, on and along that certain real property situate in the City of San �._ Leandro, County of Alameda, State of California, described as g follows: ` 37 BEGINNING at a point on the southeastern line of West Avenue 132, known as Wicks Landing Road, distant thereon north 620 east 1380.62 feet from the north- eastern line of the right of way of the Southern •• Pacific Company, as said northeastern line exists since March 10, 1944; running thence along said line of West Avenue 132 north 620 east 10 feet; thence south 28o east °°{ 993.66 feet to the southeastern line of the 42 acre { tract of land described in the deed by the Roman Catholic - Arch Bishop of San Francisco to C. Dudley DeVelbiss, et al., dated September 5, 1945, recorded December 4, 1945 in book 4810 of Official Records of Alameda County, page 239 (SS/80869); thence along the last named line south 620 west 10 feet; thence north 280 west 993.66 feet to the point of beginning. To have and to hold unto Grantee forever, with right of ingress and egress to inspect, repair and maintain a public sewer and appurtenances thereon, and for no other purpose. Pro- vided that if said sewer shall not have been constructed and placed in operation within five (5) years next following the date of this indenture, the easement and right of way herein granted may be terminated at the option of the Grantor; and provided fur- ther that if said easement and right of way, or any part thereof', shall at any time cease to be used for the purposes of a public sewer as herein stated continuously for a period of five (5) years, said easement and right of way may, at the option of the Grantor, be terminated as to any part or all of said easement and right of way not so used.
