J <br />N�►orc �' PIG4 <br />GRANT OF SEWER RIGHT OF WAY <br />THIS INDENTURE, made and entered into this 18th day of March, 1957, <br />by and between <br />MAXINELL HARDWARE COMPANY, a corporation, the Party of the First Part, <br />and the CITY OF SAN LEAJ%TDRO, a municipal corporation, the Party of --,_ <br />the Second Part. <br />WITNESSETH: That the said tarty of the First Part, does hereby grant, <br />transfer and alien unto the said Party of the Second Part the easement <br />and right of way to establish, construct and maintain for all time a <br />public sewer in, through, on and along that certain piece and strip of <br />land, situate, lying and being in the City of San Leandro, County of <br />Alameda, State of California, and particularly bounded and described <br />as follows: <br />Beginning at the northeastern extremity of that certain curve having a <br />radius of 20.00 feet, which connects the eastern line of :1stor Drive <br />with the southern line of Lake Chabot Foad, as said curve, drive and <br />road are shown on the map of "Tract 1445", filed April 1, 1955, in <br />Book 35 of Vaps, pages 82, 83 and 84, in the office of the County <br />Recorder of Alameda County; running thence along the said line of <br />Lake Chabot Road north 85 57' 50" east 11.12 feet; thence south 210 <br />52' 22" west 164.48 feet; thence south 35" 32' 59" west 117.47 feet <br />to a point on a line drawn narallel with the southwestern line of <br />Lot 89, as said lot is shown on said map, distant 10.00 feet north- <br />easterly therefrom, measured at right angles thereto; thence south <br />310 37' east 128.02 feet; thence south 42' 51' 19" east 1l.02 feet; <br />thence south 470 08' 41" west 1C.00 feet; thence north 42 51' 19" <br />west 15.00 feet to the most southern corner of said Lot 89; thence <br />along the said southwestern boundary line thereof north 310 37' west <br />135.65 feet; thence north 350 32' 11-19" east 122.91 feet; thence north <br />210 52' 22" east 158.42 feet to the point of beE-inning. <br />THIS GRANT is made by the Tarty of the First Part under the full under- <br />standing and condition that the Party of the Second Part, by acceptance <br />of this grant, has the right to remove all trees thereon that interfere <br />with the purpose for which said easement is grantee.
