(formerly County Road No. 5952) as said z3 <br />road is described in the deed from D. B. <br />Jennings, et al., Trustee, to County of <br />Alameda, dated April 5, 1916, recorded <br />May 22, 1916, in the office of the County <br />Recorder of Alameda County in Deed Book <br />2453 at page 151; thence southeasterly <br />along said southwesterly boundary line <br />of Davis Street to its intersection with <br />the said southeasterly boundary line of <br />Davis Street, said intersection being <br />also an angle point in said street; <br />thence southwesterly along the said <br />southeastern boundary line of Davis <br />Street produced southwesterly to the <br />point of beginning. Being also the <br />same area as described in the deed <br />from J. O'Connell to J. G. Jennings, <br />dated April 28, 1879, recorded May 92 <br />1879 in the office of the County Re- <br />corder of Alameda County, in Deed Book <br />1802 at page 279. Being also the same <br />area described in the deed from Lathrop <br />McD. Ellinwood, as Executor of the Will <br />of Louise G. E1linwood, to the City of <br />Oakland, dated July 28, 1954- <br />TO HAV-- AND TO HOLD unto Grantee, its successors and. <br />assigns forever, upon the express condition that said real prop- <br />erty shall be used for an outfall for a sewer, and no fill or <br />permanent structure shall be placed upon said real property <br />which shall exceed in altitude twenty-three (23) feet above <br />mean lower low water or which shall exceed the glide angle <br />prescribed by competent authority affecting the runways at <br />Metropolitan Oakland International Airport; and provided that <br />Grantor shall have an easement from time to time to install <br />upon said real property such aids to air navigation as may be <br />required by the Civil Aeronautics Administration, or its <br />successor or successors, for the safe operation of aircraft <br />approaching or departing from Metropolitan Oakland Inter- <br />national Airport, which said aids to navigation shall in <br />all instances be placed, insofar as practicable, at points <br />whereat there will be the least interference with the use of <br />said real property by Grantee. <br />IN WITNESS WHEREOF, Grantor has caused these presents <br />- 2- <br />
