CHEDULE B <br />against loss or damage by reason of matters shown in Parts One and Two hereof: <br />FART ONE: <br />1. Taxes or assessments which are not shown as existing liens by the records of any taxing authority that levies taxes or assess- <br />ments on real property or by the public records. <br />2. Any facts, rights, interests, or claims which are not shown by the public records but which could be ascertained by an inspection <br />of said land or by making inquiry of persons in possession thereof. <br />3. Easements, claims of easement or encumbrances which are not shown by the public records. <br />4. Discrepancies, conflicts in boundary lilies, shortage in area, encroachments, or any other facts which a correct survey would <br />disclose, and which are not shown by the public records. <br />5. Unpatented mining claims; reservations or exceptions in patents or in Acts authorizing the issuance thereof; water rights, claims <br />or title to water. <br />PART TWO: Liens, encumbrances, defects and other matters affecting title to said land or to which said title is subject: <br />A. Taxes for the fiscal year 1962-63, which became a lien on the <br />first Monday in March, but are not yet due and payable, the amounts <br />thereof not having been determined. <br />B. Taxes for the fiscal year 1961-62 have been paid in full. <br />1. An easement for the purpose of constructing, maintaining and <br />operating a Spur Tract over a northern portion of the premises <br />herein. As described in the deed from John J. Silva, et ux, et al, <br />to the Western Pacific Railroad Company, recorded February 21, <br />1952, in Book 6662, Official Records, Page 525, described as follows: <br />Beginning at the point of intersection of the southwesterly <br />right-of-way line of The Western Pacific Railroad Company and <br />the northwesterly property line of the Grantors, said north- <br />westerly property line being the southeasterly line of Parcel <br />of that certain parcel of land conveyed by Alameda Egst Bay <br />Title Company to The Western Pacific Railroad Company by deed <br />recorded March 6, 1950, in Book 6041 of Official Records of <br />Alameda County, California, Page 125; thence from said point of <br />beginning along said southwesterly right-of-way line South 49° <br />07' East a distance of 87.74 feet; thence northwesterly n 1ong_ <br />a curve, (the center of said curve bears North 290 31' 48" East <br />487.68 feet) through an angle of 100 24, 19" an are distance of <br />88.57 feet to a point on said southeasterly line of said Parcel <br />7r5; thence along said southeasterly line North 420 03' East 9.48 <br />feet to the point of beginning; containing 534.23_square feet, <br />more or less. <br />
