Q982190 / <br />GRANT OF EASEMENT <br />A. W. SWEASEY and ELLA L. SWEASEY, his wife, in consideration of the sure <br />Of One Dollar ($1.00), receipt of which is hereby acknowledged, hereby <br />;;rant to the CITY OF SAN LEANDRO, a municipal corporation, hereinafter <br />called "City", and its successors and assigns, an easement for the <br />purpose and upon the conditions hereinafter set forth upon and along <br />that certain strip of real property in the City of San Leandro, County of <br />Alameda, State of Calif nrnia, described as follows: <br />A strip of land 10 feet wide across Lot 5, Tract 1026, City <br />of San Leandro, Alameda County, California, lying 5 feet to each <br />side of the below -described centerline. <br />Beginning at a point on the westerly line of said Lot 5 and <br />5.10 feet northerly from the southwest corner of said lot, measured <br />along the westerly line thereof; thence north 590 40* 113" east <br />37.17 foot, more or less, to a point on a circular curve, concave to <br />the southeast and having a radius of 40 feet, said curve being the <br />southeasterly boundary line of said lot and said point being 6.50 feet, <br />chord distance, from the most westerly southeast corner of said Lot 5 <br />and the most northerly corner of Lot 6 of said Tract 1026. <br />The map of the above -mentioned Tract 1026 was filed in the Office <br />of the Recorder of Alameda County, California on June 9, 1950 in <br />Book 30 of Maps, page 74, Records of Alameda County. <br />Said easement is and shall be subject to each and all of the following <br />provisions, conditions, and covenants to which the parties hereto mutually <br />agree: <br />Said easement shall be used for the construction and maintenance of Sanitary <br />sewers. Work to be performed by the City shall be done in such a manner <br />that possible damage to existing structures, paving or plants shall be <br />minimized. 'Pie foregoing improvements shall not be removed if possible <br />to avoid the same. Damage, if any, to said improvements, shall be repaired <br />or the same replaced by the City to the same condition such improvements <br />were in at the date of acquisition of the properties. <br />IN WITNESS WHEREOF, the grantors have executed this agreement this <br />e�0 day of , 1959. <br />This is to certify that the interest in real property conve;red by the deed or <br />grant dated May 28, 1959, from A. W. Sweasey and Ella L. Sweasey to the City <br />of San Leandro, a political corporation, is hereby accepted by order of the <br />�4 City Council of the City of San Leandro on December 16, 1957, and t e grant <br />consents to recordation thereof by its duly author' r r.
