� AGREEMENT <br />This Agreement made December �O/ 1958, by AvansiiLo-Mortensen & Co., <br />P. .California corporation, Roy C. Ricketts and Ruby E. Ricketts, his wife, <br />and City of San Leandro, a municipal corporation, <br />Recitals <br />The Ricketts are deeding certain property to the City of San Leandro <br />storm drainage, Avansino4Iortensen & Co„ likewise are deeding other <br />pLc-iperty to the City of San Leandro for storm drainage. <br />Now, therefore, the parties agree as follows° <br />1. Avansino-Mortensen & Co. shall bear the cost of all <br />labor and material required to install the 12" R.C.P. <br />between their property and the existing storm drain <br />in Carmel Way, including the headwall and handhole, <br />all as shown on Drawing 12, Case 705. <br />2. This work will be to City standards and requirements <br />and will have City inspection. <br />3. Any improvements, including structures, foundations, <br />shrubs, plants, lawns, fences, or sidewalks damaged <br />in this work shall be repaired or replaced to the <br />satisfaction of Mr. Ricketts at the expense of <br />Avartsino-Mortensen & Co. <br />4. At no time shall the size of pipe in this easement <br />exceed 12". <br />5.
