That the granting cf such application will' not, <br />under the circumstances of the particular case, <br />;-r_aterially ailect adversely the he alth or safety <br />of persons residing or working in the neighbor- <br />hood of the property of the applicant and will <br />not under the circumstances of the particular <br />case, be materially Detrimental to the public <br />welfare or injurious to property or improve- <br />rrients in said' neighborhood. <br />114.42 Public wearing: <br />(a) A pu'?lic hearing shall be held within thirty (30) <br />::lays after filing of application, notice of the time, <br />place, and' purpose of which shall be given by one <br />(1) publication in a newspaper of general circulation <br />in the City at least five (5) clays prior to such hear- <br />ing and by posting notice on the property involved or <br />of jacent thereto at least five (5) Clays prior to such <br />hearing. <br />114.43 Action t v Gonlmis sion: <br />(a) After the conclusion of the public hearing, the <br />:Planning t.ominission shall make a written fincing <br />of facts showing whether the qualifications under <br />Section 4.4_1(a) apply to the land, bulloing or use <br />for which variance is sought and whether such vari- <br />ance shall be in harmony with the general purposes <br />of this ordinance. Such written finding of facts <br />shall be submitted to the City Council within thirty <br />(30) days after the public hearing and may incluce <br />recommendations for such con6itions as the Plan- <br />ning Commission deems necessary to secure the <br />purposes of this ordinance. <br />114.44-- Action by City Council: <br />(a) Ehe City Council shall consider the application <br />for variance within thirty (30) clays after receipt of <br />the Planning Cornrnission report and, if the City <br />Council finds that the qualifications under Section <br />4.41(a) apply to the land, building, or use for which <br />variance is sought anc, that such variance is in harm.-- <br />ony with the general purposes of this ordnance, sail <br />City Council shall by resolution grant such varia�ice. <br />(b) The City Council may :lesignate such conditions <br />in connection with the variance as it cdeerns necessary <br />to secure the purposes of this ordinance andrnay re- <br />quire such guarantees ant! evidence that such condi- <br />tions are being or will be complied with. ` <br />That the zoning Ordinance of the :;ity of Sass Leandro provides foz <br />axnendments as follows: <br />SPRUANCE S SIMONIAN it <br />ATTORNEYS AT LAW <br />1514 WASHIN13TON AVE.
