This Option may be assigned by the Purchaser either <br />before or after the Purchaser shall have given notice of his election to <br />exercise this Option. <br />This Option is specifically conditioned upon the adoption by Pur- <br />chaser prior to January 23, 1962, of a resolution finding and determining that <br />the public interest and necessity require the acquisition of said property for <br />public purposes, and finding and determining that the taking thereof in fee <br />simple is necessary. in the absence of the adoption of such resolution, this <br />Option shall be null and void, and in such event Seller agrees to return to <br />Purchaser the One Hundred Dollars ($100) received by Seller from Purchaser, <br />and Purchaser agrees to execute to Seller a deed quitclaiming any interest in <br />and to said property arising as a result of this Option. <br />Dated at San Leandro, California, this loth day of January, 1962. <br />GARVCO, INCORPORATED <br />- 2 - <br />t1 `tea_ <br />
