As you recall, the Final Order of Condemnation in this matter was file -endorsed on March 8, 1962. A memo was sent to Dick West on March 17, 1978, by the City Attorney's Office requesting the Clerk to record this document; evidently, the Clerk did not follow through. In February of 1988, I received a call from Sandra Nielson, the daughter of the property owners questioning the City's ownership of the parcel condemned in the 1962 action since the Alameda County Recorder had no record of the Final Order. After digging out our old closed files and several trips to the County offices, it was discovered that the Final Order had never been recorded. In March of last year our office took another copy of the file -endorsed Final Order of Condemnation to the Alameda County Clerk's Office for certification then forwarded it to Georgia by my memo of March 11, 1988, with instructions to have the Final Order recorded. According to your telephone call of June 13, 1989, apparently, this certified copy of the Final Order was again lost in the shuffle. To ensure that the Final Order was finally recorded and to eliminate the possibility of the paperwork being misplaced again, we once again pulled our closed files and had a file -endorsed copy certified and then submitted the Final Order to the Alameda County Recorder for recordation. Enclosed is a conformed copy stamped by the Recorder this date. Upon recordation, the certified Final Order will be returned to the City Clerk's Office.
