41 w AGREEMENT This Agreement, made and entered into as of this 19th day of `arch 196h geeeZer; 4-6 , by and between the City of San Leandro, a municipal corporation, hereinafter called ''City,'' and Richfield Oil Corporation, hereinafter called ''Company,'' RECITALS For purposes of widening the public roadway and improving the flow of traffic, it is necessary that the City of San Leandro acquire certain property located at the corner of Marina Boulevard and Merced Street in the City of San Leandro. This property is presently owned by Robert W. Hummel and Irene Viner Hummel, his wife. Richfield Oil Corporation has a lease thereon, together with other property for use as a service station. The property sought to be acquired by the City of San Leandro consists of an area irregular in shape totaling ap- proximately 343 square feet as described in the Exhibit "A" hereof. Richfield Oil Corporation has a company light standard and flood- lights located on the property to be acquired by the City. Richfield Oil Corporation is aware that said property is being purchased by the City from said Robert W. Hummel and Irene Viner Hummel. Now, therefore, the parties hereto agree as follows: Company agrees that the property leased by said Company from said Robert W. Hummel and Irene Viner Hummel shall be and hereby is decreased in area so as to exclude from said lease the property to be purchased by the City, and Company hereby surrenders and releases any and all interest under said lease to said property to be so acquired, and hereby disclaims any interest in said property. Company further agrees that the total price to be paid for the land by the City shall be paid in its entirety to the Owners of said property.
