r2l IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 66 - 38 RESOLUTION AUTHORIZING EXECUTION OF GRANT DEED (Lew Ward Hudson, Jr.) Recitals In October, 1965, the City of San Leandro acquired by grant deed from Lew Ward Hudson, Jr., and Mildred D. Hudson, his wife, certain property located in the City of San Leandro for street purposes. The property which the City intended to acquire and that which the grantors intended to convey was a portion of a larger parcel of property owned by the grantors. Through clerical error of the title insurance company, a deed of the entire parcel of property owned by said parties was submitted to and accepted by the City of San Leandro. At no time did the City of San Leandro intend to acquire the entire parcel of property, and at no time did the City of San Leandro pay considera- tion to the owners of said property for such entire parcel of land. The con- sideration paid by the City of San Leandro was for the acquisition of a por- tion of the larger parcel. It is in the mutual interest of both the City and the parties above named to correct the clerical error of the title insurance company by con- veying to said parties that portion of said property described in that certain grant deed dated February 8, IQ66 a copy of which is attached hereto and by reference incorporated herein. Now, therefore, the City Council of the City of San Leandro does RESOLVE as follows: That the Mayor of the City of San Leandro be and he hereby is authorized to execute a grant deed reconveying to Lew Ward Hudson, Jr., and Mildred D. Hudson, his wife, certain property within the City of San Leandro described in said deed, a copy of which is attached hereto.
