MT <br />600914 <br />p age 2 <br />NOTE: ACTION PENDING, commenced February 25, 1957 in <br />uperior Court, Alameda County, Case No. 279944, entitled t'Giovanni <br />Accatino and Margherita Accatino, his wife, plaintiffs, vs. Richard <br />A. Thomas and Marjorie M. Thomas, his wife, American Trust Co., a <br />corporation, American Securities Co., a corporation, defendants", <br />wherein plaintiff prays that they are the owners of an easement and <br />right of way, for ingress and egress by foot, automobile and vehicles, <br />over, across and through the strip of land 10 feet wide located on a <br />portion of the Thomas property (property adjoining premises on the <br />southeast); and running along a curve to a northwesterly direction <br />from Washington Avenue to the southerly property line of plaintiffs, <br />property, the northerly boundary of said 10 foot strip of land com- <br />mencing on the westerly side of Washington Avenue, approximately 21 <br />feet south from the southeast corner of plaintiffs' property and the <br />northeast corner of the Thomas property; and running a distance of <br />approximately 42 feet along a curve in a northwesterly direction to <br />the southerly boundary line of plaintiffs' property and the south- <br />ern boundary of said 10 foot strip of land commencing on the west- <br />erly side of Washington Avenue, approximately 31 feet south of the <br />southeast corner of plaintiffs, property and the northeast corner <br />of the Thomas property; and running along a curve in a northwesterly <br />direction to the southern boundary line of plaintiffs, property, a <br />distance of approximately 60 feet, said right of way and easement <br />over said 10 foot strip of land having been at all times mentioned <br />herein, surfaced with concrete and having been at all times mentioned <br />herein a part of the driveway to plaintiffs' residence situated on <br />plaintiffs' property. <br />No examination has been made of the title to the property <br />affected by the easement sought to be established, and policy, when <br />issued, will not insure such easement. <br />
