IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2022-139 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AMENDMENT 2 TO A CONSULTING SERVICES AGREEMENT WITH TESTING ENGINEERS, INC. TO INCREASE THE AMOUNT OF COMPENSATION BY $10,000 FOR A TOTAL NOT TO EXCEED AMOUNT OF $95,000 FOR THE FARRELLY POOL REPLACEMENT, PROJECT NO. 2018.3420; AND TO AUTHORIZE EXTENSION OF THE CONTRACT TERM FROM DECEMBER 30, 2021 TO DECEMBER 31, 2022 WHEREAS, an agreement dated September 30, 2019 exists between the City of San Leandro and Testing Engineers, Inc.; and WHEREAS, a contract amendment is required to compensate for additional consulting services for design revisions, construction administration, and field observation; and WHEREAS, Testing Engineers, Inc. has agreed to the terms of the amendment pending Council approval; and WHEREAS, Amendment No. 2 to the agreement; of which copies of the scope and compensation are attached, was presented to this City Council; and WHEREAS, the City Council is familiar with the contents thereof, and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That said Amendment No. 2 substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and 2. That the City Manager is authorized to make non -substantial revisions to said agreement, subject to approval as to form by the City Attorney; and 3. That said City Council hereby authorizes the City Manager to negotiate, approve, and execute the agreement for testing services with Testing Engineers, Inc. for an amount not to exceed $95,000. 4. That an original executed Amendment 2 shall be attached to and made a part of this resolution.
