LEE CONSTRUCTION CO., a California corporation, hereinafter called <br />Lee, LEALAND HEIGHTS INC., a corporation, hereinafter called Lealand, and the <br />CITY OF SAN LEANDRO, a municipal corporation, hereinafter called City. <br />Recitals <br />Lee is the owner of Parcel A of Parcel Map No. 353 as shown by Map on <br />file in Book 58, page 29 of Maps, Records of Alameda County. <br />Lealand is the owner of Parcel B of said Parcel Map. <br />Said lots are contiguous to each other in such manner that the north- <br />westerly line of said Parcel A forms the southeasterly line of said Parcel B. <br />Lee and Lealand desire to construct buildings upon said lots in such <br />manner that access to the rear of said lots is required in order to fulfill <br />off-street parking requirements of the San Leandro Municipal Code of 1957. <br />Lee and Lealand desire to create and utilize a common driveway for said lots. <br />NOW, THEREFORE, the parties hereto mutually agree as follows: <br />In consideration of City's granting building permits for Parcels A and <br />B of Parcel Map No. 353: <br />Lee agrees to convey to Lealand an easement for driveway and incidental <br />purposes over and across a strip of land 6.50 feet wide, extending along the <br />northwesterly line of said Parcel A for its entire distance; and <br />Lealand agrees to convey to Lee an easement for driveway and incidental <br />purposes over and across a strip of land 6.50 feet wide, extending along the <br />southeasterly line of said Parcel B for its entire distance. <br />Deeds evidencing said conveyances, marked "Exhibit A" and "Exhibit B" <br />are attached hereto and by this reference incorporated herein. <br />The easements granted herein are to be held by the respective grantees, <br />their heirs and assigns as appurtenant to the lots owned by the respective <br />grantees, and shall not be terminated without the prior written consent of <br />City.
