BLUE San Leandro, California 94577 ) coUNTV RECORDER Space above this line for Recorder's use GRANT OF EASEMENT THE WESTERN PACIFIC RAILROAD COMPANY, a corporation, Grantor, does hereby GRANT unto the CITY OF SAN LEANDRO, a municipal corpora- tion of the State of California, Grantee, an easement for the construction, operation and maintenance of a public street over and across that certain real property situate in the County of Alameda, State of California, more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof as fully as if herein set forth at length. This easement is granted upon the following conditions: 1. Grantee shall construct said public street upon the herein described premises without cost or expense to Grantor. 2. In the event that the herein described real property or any part thereof shall ever cease to be used for the purpose provided in this deed, the easement, or such part thereof as shall have ceased to be so used, and all right, title and interest of Grantee, its successors or assigns, therein shall revert to Grantor, its successors or assigns. This instrument is subject to all valid existing contracts, leases, liens, encumbrances or claims of title which may affect the real property herein described, and the word "grant" as used herein shall not be construed as a covenant against the existence of any thereof.
