BLUE <br />San Leandro, California 94577 <br />) coUNTV RECORDER <br />Space above this line <br />for Recorder's use <br />GRANT OF EASEMENT <br />THE WESTERN PACIFIC RAILROAD COMPANY, a corporation, Grantor, <br />does hereby GRANT unto the CITY OF SAN LEANDRO, a municipal corpora- <br />tion of the State of California, Grantee, an easement for the <br />construction, operation and maintenance of a public street over and <br />across that certain real property situate in the County of Alameda, <br />State of California, more particularly described in Exhibit "A" <br />attached hereto and by this reference made a part hereof as fully <br />as if herein set forth at length. <br />This easement is granted upon the following conditions: <br />1. Grantee shall construct said public street upon the <br />herein described premises without cost or expense to Grantor. <br />2. In the event that the herein described real property or <br />any part thereof shall ever cease to be used for the purpose provided <br />in this deed, the easement, or such part thereof as shall have <br />ceased to be so used, and all right, title and interest of Grantee, <br />its successors or assigns, therein shall revert to Grantor, its <br />successors or assigns. <br />This instrument is subject to all valid existing contracts, <br />leases, liens, encumbrances or claims of title which may affect <br />the real property herein described, and the word "grant" as used <br />herein shall not be construed as a covenant against the existence <br />of any thereof. <br />IN WITNESS WHEREOF, Grantor has, by its officers thereunto <br />1. <br />
