AGREEMENT <br />Agreement, made this 31st day of August , 1959, between <br />the City of San Leandro, a municipal corporation, hereinafter called City, and <br />Bayfair, a corporation, hereinafter called Owner, witnesseth: <br />City is the owner of an easement situated in the City of San Leandro, <br />Alameda County, California, described as follows: <br />A ten foot wide easement across the southwesterly portion of <br />Bayfair running in a general southeasterly and southerly <br />direction, the centerline of said easement being more par- <br />ticularly described as follows: <br />Beginning at a point from which the northwest corner of said <br />Bayfair parcel (said northwest corner being the northwest cor- <br />ner of that parcel described in quitclaim deed from R. H. Macy <br />and Coo, Inc., and Capitol Company to Bayfair, a California <br />corporation, recorded February 6, 1956, in Book 7926 at Page <br />525, Official Records of Alameda County, California) bears <br />N. 220 42? W. 232.7 feet, more or less; thence S. 38° 091 E. <br />299.5 feet, more or less, to an angle point; thence S. 39° <br />481 E 278.1 feet, more or less, to an angle point; thence <br />So 6.8 feet, more or less, to the south line of said Bayfair <br />parcel. <br />Owner desires to construct a bowling alley over, upon, and along <br />said easement, <br />Now, therefore, the City hereby gives Owner permission to construct <br />a bowling alley over, upon, and along said easement, such permission to be <br />revokable by City upon six months, written notice. Owner agrees at his own <br />cost to do all work in the hereinabove portion of said easement and expressly <br />agrees to maintain the easement at all times to the satisfaction of City. City <br />shall have the right of access through, over, and upon said easement at all <br />times. <br />Owner agrees that if for any reason City desires to inspect, repair, <br />replace or otherwise maintain the City Qs facilities now or hereafter to be <br />located within the easement, that it will remove, at its own cost, any or all <br />existing structures or other work which may be located by it within said ease- <br />ment and to replace the same at its own cost after such work is completed. <br />If, for any reason (including but not limited to the cancellation of <br />this permit) this license is terminated, Owner will at its own cost, remove all <br />
