2.20.010 <br />Chapter 2.20 <br />PROPERTY DISPOSITION AND <br />DEVELOPMENT <br />Sections: <br />2.20.010 <br />General. <br />2.20.020 <br />Purchase and <br />development. <br />2.20.030 <br />Purchase and development <br />documents. <br />2.20.040 <br />Development of publicly <br />owned improvements. <br />2.20.050 <br />Personal property <br />disposition. <br />2.20.010 General. <br />For the purpose of this plan, the agency is <br />authorized to sell, lease, exchange, subdivide, <br />assign, encumber or otherwise dispose of any <br />interest in real property. Such activity will be <br />carried out as permitted by law. <br />To the extent permitted by law, the agency is <br />authorized to dispose of real property by leases <br />or sales by negotiation without public bidding. <br />All real property acquired by the agency in <br />the project area shall be sold or leased to per- <br />sons or entities for development for the uses <br />permitted in this plan. Real property may be <br />conveyed by the agency to the city or county or <br />any other public body without charge. <br />The agency shall reserve such powers and <br />controls in any disposition and development <br />documents as may be necessary to prevent <br />transfer, retention, or use of property for specu- <br />lative purposes and to insure that development <br />is carried out pursuant to this plan. <br />All purchasers or lessees of property shall be <br />obligated to use the property for the purposes <br />designated by this plan, to begin and complete <br />development of the property within a period of <br />time which the agency fixes as reasonable, and <br />to comply with other conditions which the <br />agency deems necessary to carry out the pur- <br />poses of this plan. <br />In the manner required and to the extent <br />permitted by law, before any property of the <br />agency acquired in whole or in part, directly or <br />indirectly, with tax increment monies is sold or <br />leased for development pursuant to plan, such <br />sale, lease or other disposition shall be done in <br />accordance with the provisions of Health and <br />Safety Code Section 33433. <br />To the greatest extent allowed in implement- <br />ing this plan, the agency shall avoid unneces- <br />sary duplication with city and county regula- <br />tions for agreements with property owners <br />and/or developers. (Ord. 93-012 § 425, 1993) <br />2.20.020 Purchase and development. <br />Pursuant to the provisions of this plan and <br />the rules adopted by the agency, the agency <br />shall to the greatest extent feasible offer real <br />property acquired by the agency for disposition <br />and development by owner participants on a <br />preference basis over other persons.
