(Ord. 93- <br />012 § 503, 1993) <br />2.28.030 Other public uses. <br />Parking, open space, public and semi- <br />public uses may be interspersed, with other <br />uses in any area. (Ord. 93-012 § 504, 1993) <br />2.28.040 Other public, semi-public, <br />institutional and nonprofit <br />uses. <br />In any area the agency is authorized to <br />permit the maintenance, establishment or <br />enlargement of public, semi-public, insti- <br />tutional or nonprofit uses, including park and <br />recreational facilities, parking facilities, <br />libraries, educational, fraternal, employee, <br />philanthropic, and charitable institutions, <br />utilities, multi -model transit facilities, and <br />facilities of other similar purposes, <br />associations or organizations. All such uses <br />shall conform so far as possible to the <br />provisions of this plan applicable to the uses <br />in the specific area involved. The agency may <br />impose such other reasonable restrictions as <br />are necessary to protect the development and <br />uses in the project area. (Ord. 93-012 § 505, <br />1993) <br />2.28.050 General controls and <br />limitations. <br />All real property in the project area is made <br />subject to the controls and limitations of this <br />plan. No real property shall be developed, <br />rehabilitated. or otherwise changed after the <br />date of the adoption of this plan, except in <br />conforming with the provisions of this plan. <br />The agency reserves the right to condition any <br />development which requires a building permit <br />with such conditions as to make the proposed <br />2.28.030 <br />development consistent with the overall <br />purposes of this plan. The type, size, height, <br />number, and use of buildings within the <br />project area shall be controlled by applicable <br />city and county planning and development <br />codes consistent with general plans, as <br />amended from time to time. (Ord. 93-012 § <br />506, 1993) <br />2.28.060 New construction. <br />Except as otherwise permitted or required <br />by the agency all new construction shall <br />comply with all applicable state and local laws <br />and regulations pertaining thereto as amended <br />from time to time, including without <br />limitation the building, electrical, energy, <br />heating and ventilating, housing and plumbing <br />codes of the city and county and the city and <br />county development codes, as amended from <br />time to. time. Off-street parking spaces and <br />loading facilities shall be designated to <br />comply with the city's or county's <br />development codes, as amended from time to <br />time. The number of off-street parking spaces <br />required shall be regulated by the city's or <br />county's development codes, as amended <br />from time to time. All off-street parking <br />spaces and loading areas shall be paved, <br />lighted and landscaped in accordance with the <br />city's or county's development codes, or other <br />applicable city or county regulations, as <br />amended from time to time. (Ord. 93-012 § <br />507, 1993) <br />2.28.070 Existing nonconforming <br />uses. <br />The requirements of the municipal or <br />county zoning codes shall determine if <br />existing nonconforming uses will remain in <br />the project area. <br />79 <br />
