MCKEE,TASHEIRA & WAHRHAFTIG
ATTORNEYS AT LAW
BANK OF AMERICA BUILDING
OAKLAND, CALIFORNIA
_12
SAMUEL BELL MCKEE, 1660- 1920
ARTHUR G.TASHEIRA.1878-1936
MATT WAHRHAFTIG
RIDLEY STONE
:i_arch 0, 1944
i 0.
D. K. Gilmore, Lsq.
Attorney at Law A k _v
oe
Best Building ,'
`0
San Leandro, California ,
Dear Dave s6o4 It

The address Mat' da J. Eaton and Emmett C. Eaton, her
husband, is 2549 K¢ IIo Street, Oakland, and their telephone
number is Andover O ;4 I presume that you are more familiar with
this title than I but am nevertheless giving you certain facts
concerning it.
In the first place I am enclosing a pencilled diagram of
the land in question.
The history of the title is as follows:
The Eatons acquired this land from the Flanagans by a
deed executed by Joseph Flanagan and Katherine J. Flanagan, his
wife, to Matilda J- Eaton, dated July 2, 1926, and recorded July
19, 1926, in Book 1348 of Cfficial Records, page 200. Yatilda J.
Eaton and her husband on the same day executed a deed of trust to
the Flanagans with the Alameda County Title Insurance Company as
trustee in the amount of $3750.00. I presume that this was for the
purchase price. This deed of trust was subsequently assigned by
the rlanagans to The American Bank, later the American Trust Com-
pany.
On October 28, 19279 Matilda J. Eaton and E. C. Eaton,
her husband, conveyed the land to Lucille W. Cheever, a single woman,
by deed dated October 28, 1927, recorded November 59 1927, in Book
1735 of Official Records, page 136, in the office of the County Re-
corder of Alameda County. Charlotte F-T. uieger was the Notary. I
mention this because in my conversation with Yrs. Eaton she remem-
bered the Notary. You may recall that Yrs. tiueger is the daughter
of Billy Hamilton, who was Chairman of the Board of Supervisors
here for many years.
As I understand it, prior to the date of -the Cheever deed
the line of Santa Clara or Bancroft Avenue had been changed so that
when the Eatons conveyed away the property there is a question as
to whether their deed started at the old line or the new line.
