<br />This Quitclaim and Release is ecuted by the undersigned
<br />at Castro Valley, California, this 6th day of December, 1966.
<br />RECITALS:
<br />1. Pursuant to the Final Order of Condemnation in
<br />Action No. 338695, arising in the Alameda County Superior Court,
<br />State of California, the defendants in that lawsuit have the privilege
<br />to use under permit from plaintiff for roadway purposes incident
<br />to any subdivision plan that portion of property within the State
<br />right-of-way described as follows:
<br />COMMENCING at the northwesterly terminus of the course
<br />shown as "S. 300 50' E., 96.38 feet", on Lot 1 in
<br />Block 3, as said lot and block are shown on the map
<br />entitled "Tract 727, Eden Township, Alameda County,
<br />California" filed March 29 1946, in Book 11 of Maps,
<br />pages 50 and 51, in the office of the County Recorder
<br />of Alameda County; thence N. 10 26' 55" W., 98.18 feet;
<br />thence S. 19' SO' 26" E., 265.85 feet to the
<br />southwesterly line of existing Foothill Boulevard;
<br />thence along last said line N. 300 00' 40" W.,
<br />175.44 feet to the point of commencement.
<br />2. A. ALLEN AQUILINO, INC., a California corporation, is
<br />the successor in interest to all rights that defendants G. C. NICHANDROS,
<br />also known as R. C. NICHANDROS, DOROTHY M. NICHANDROS, NICHANDROS
<br />DEVELOPMENT CO., INC., a corporation, and CREST ENTERPRISES, INC.,
<br />a corporation, in the said property by reason of a deed dated
<br />March 14, 1966 and recorded March 18, 1966, in Reel 1729, Image 281,
<br />Alameda County Records.
<br />3. A. ALLEN AQUILINO, INC., is willing to release any
<br />rights that it has presently under the Final Order of Condemnation
<br />subject to the State of California relinquishing its interest in this
<br />property to the City of San Leandro to be used for road purposes.
<br />THEREFORE, FOR VALUATION CONSIDERATION:
<br />1. A. ALLENPQUILINO, INC., does hereby release and
<br />quitclaim to the City of San Leandro all of its right, title and
