_ RF:3081 X959 <br />7(-.32987 664 <br />Book 3458 of Official Records, page 119. (Said deed conveys all interest <br />of The Morgan Oyster Company in any real property in Alameda County, but <br />does not describe any property. The Assessor's records show The Morgan <br />Oyster Company as vestee of the subject portion of Tide Land Survey No. 107 <br />in 1937). That portion of said parcel lying North of said 5 Mile Limit <br />Line is not in the Tide Lands or Swamp and Overflowed Salt Marsh Surveys <br />and is vested in the State of California, and has never been in private <br />ownership. <br />THEREFORE, <br />1. Parcel 8OG-910-6 resulted from misinterpretation and misapplication <br />of the record and has been removed from the Assessment Roll; <br />2. The deed from Trojan Powder Company to the City of San Leandro con- <br />veying title in said parcel 80G-910-6 only by reference to the Assessor's <br />parcel number, depends upon the existence of said parcel and Trojan Powder <br />Company's interest therein. Because the land within the parcel lies outside <br />of Tide Land Survey No. 104 and the record shows no interest of Trojan Powder <br />Company therein, the deed is invalid. <br />3. The adjacent Assessor's Blocks have been adjusted to show title to <br />this land vested in Ideal Cement Company and the State of California, divided <br />by the 5 :Mile Limit Line, as they were shown prior to January 16, 1957; <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE <br />as follows: <br />That this City Council declares the truth of the above recitals and <br />directs the City Clerk of the City of San Leandro to certify and record this <br />resolution with the County Recorder of Alameda County. <br />Introduced by Councilman Kant and passed and adopted this 6th day of <br />March, 1972, by the following called vote: <br />Members of the Council: <br />Ayes: Councilmen Kant, Nahm, Polvorosa, Pomares, Suerstedt; <br />Mayor Maltester ( 6 ) <br />Noes: None ( 0 ) <br />Absent: Councilman Coppa ( 1 ) <br />r <br />Attest: ^ <br />Richard H.
