(Said deed conveys all interest of The Morgan Oyster Company in any real property in Alameda County, but does not describe any property. The Assessor's records show The Morgan Oyster Company as vestee of the subject portion of Tide Land Survey No. 107 in 1937). That portion of said parcel lying North of said 5 Mile Limit Line is not in the Tide Lands or Swamp and Overflowed Salt Marsh Surveys and is vested in the State of California, and has never been in private ownership. THEREFORE, 1. Parcel 8OG-910-6 resulted from misinterpretation and misapplication of the record and has been removed from the Assessment Roll; 2. The deed from Trojan Powder Company to the City of San Leandro con- veying title in said parcel 80G-910-6 only by reference to the Assessor's parcel number, depends upon the existence of said parcel and Trojan Powder Company's interest therein. Because the land within the parcel lies outside of Tide Land Survey No. 104 and the record shows no interest of Trojan Powder Company therein, the deed is invalid. 3. The adjacent Assessor's Blocks have been adjusted to show title to this land vested in Ideal Cement Company and the State of California, divided by the 5 :Mile Limit Line, as they were shown prior to January 16, 1957; NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That this City Council declares the truth of the above recitals and directs the City Clerk of the City of San Leandro to certify and record this resolution with the County Recorder of Alameda County.
