"Hiking and bicycle trail" as that term is used herein <br />shall mean a pathway available for use by the public on a per- <br />manent basis for hiking, walking, sightseeing, bicycling, or <br />any other similar form of recreational activity, if and to the <br />extent, deemed appropriate by CITY, at its sole discretion. <br />3. This grant of easement shall include the right in <br />CITY, its successors and assigns, of construction, installation, <br />maintenance and repair of any appurtenances, insofar as, and <br />to the extent such appurtenances constitute a reasonable exercise <br />of the purposes described herein. <br />4. The foregoing 12-foot right-of-way shall be installed, <br />constructed, reconstructed, repaired and maintained solely at the <br />cost and expense of CITY, without right of reimbursement or assess- <br />ment from CITATION, or any real property described in EXHIBIT 2 <br />hereto, or any grantee or successor grantees of CITATION. <br />5, CITATION does hereby further grant to CITY a construction <br />easement in, through, along and under the real property described <br />in Exhibit 1 hereto for the purpose of operating, storing and main- <br />taining equipment and performing such other operations as required <br />to accomplish the installation and construction of the aforesaid <br />12-foot hiking and bicycle trail, said construction easement to <br />terminate upon the completion of such installation and construction <br />or on October 1, 1987, whichever first occurs. <br />-2- <br />
