WEST, CITY CLERK <br />CITY 46F SAN LEANDRO <br />THIS INDENTURE made and entered into this ��� day of , ry /-e,,�, <br />19 -111-by and between the ALAMEDA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT, <br />a body corporate and politic, hereinafter called the Grantor, and CITY OF SAN LEANDRO, <br />a municipal corporation, hereinafter called the Grantee. <br />W I T N E S S E T H: <br />That Grantor for a good and valuable consideration, the receipt and sufficiency <br />whereof is hereby acknowledged, does hereby grant, subject to all of the terms and <br />conditions hereof, to Grantee, its successors and assigns, an easement and right of <br />way for bridge and roadway purposes, in, under, along and across that certain real <br />property in the City of San Leandro, County of Alameda, State of California described <br />in Exhibit "A" attached hereto and made a part hereof. <br />Said easement and right of way is granted upon the following terms and conditions: <br />1. Grantee agrees to repair any and all damage to Grantor's property <br />caused by Grantee's use of said property and to indemnify and hold <br />Grantor harmless from and against any and all cost, expense, loss, <br />damage, liability, claims or causes of action, liability for damages, <br />injuries to or death of any person, which shall in any way arise <br />out of or be connected with Grantee's use of said easement and right <br />of way, unless such damage, loss, injury or death shall be caused solely <br />by the negligence of Grantor. <br />2. Prior to commencement of any work in said easement and right of <br />way which includes maintenance and repair, the plans and specifications <br />of such work shall be approved by the Alameda County Flood Control <br />and Water Conservation District, provided further that the Grantee <br />shall not use said parcel of land, nor permit the same to be used, for <br />any purposes or in any manner which will interfere with the use of the <br />property for its primary purpose of flood control. <br />IN WITNESS WHEREOF, the Grantor has hereunder set its hand the day and <br />year first above written. <br />ALAMEDA COUNTY FLOOD CONTROL AND <br />WATER CONSERVATION DISTRICT <br />=- Appria,P�tE, <br />. to v n <br />RICIi ARD J.
