BLUE CITY QF SAN LEANDRO <br />COUNTY REIC:ORUtk <br />GRANT OF EASEMENT <br />THIS INDENTURE made and entered into this a� �-�- day of <br />A-e-y 19 by and between the ALAMEDA COUNTY FLOOD CONTROL <br />AND WATER CONSERVATION DISTRICT, a body corporate and politic, hereinafter called <br />f7'1 <br />1i�1�9bJ <br />the Grantor, and CITY OF SAN LEANDRO, a municipal corporation, hereinafter called <br />the Grantee. <br />W I T N E S S E T H: <br />That Grantor for a good and valuable consideration, the receipt and sufficiency <br />whereof is hereby acknowledged, does hereby grant, subject to all of the terms and <br />conditions hereof, to Grantee, its successors and assigns, an easement and right of <br />way for roadway purposes, in, under, along and across that certain real property in <br />the City of San Leandro, County of Alameda, State of California described in Exhibit <br />"A" attached hereto and made a part hereof. <br />Said easement and right of way is granted upon the following terms and conditions: <br />1. Grantee agrees to repair any and all damage to Grantor's property <br />caused by Grantee's use of said property and to indemnify and hold <br />Grantor harmless from and against any and all cost, expense, loss, <br />damage, liability, claims or causes of action, liability for damages, <br />injuries to or death of any person, which shall in any way arise out <br />of or be connected with Grantee's use of said easement and right <br />of way, unless such damage, loss, injury or death shall be caused solely <br />by the negligence of Grantor. <br />2.
