30.FUNDS ASSIST INDEMNIFICATION <br />Grantee and sub grantee (hereafter known an Agency A and Agency B respectively) shall be <br />responsible for, and DPR shall not be answerable or accountable in any manner for, any loss <br />or expense by reason of any damage or injury to person or property, or both, arising out of or <br />related in any way to activities carried out by Agency A and B, its agents, officers, <br />contractors, subcontractors and/or employees, under this Agreement Agency A and B shall <br />protect, hold harmless, indemnify and defend DPR, its agents, officers, and/or employees <br />against any and all actions, claims, and damages to persons or property, penalties, <br />obligations and liabilities that may be asserted or claimed by any person, firm, association, <br />entity, corporation, political subdivision, or other organization or person arising out of or in <br />connection with Agency A and B’s contractor’s or subcontractor’s activities hereunder, <br />whether or not there is concurrent passive negligence on the part of DPR, its agents, officers, <br />and/or employees. <br />If Agency B is a recipient of a current SAVE grant, as depleted or with insufficient funds for <br />removal project, and receives assistance through the Funds Assist process, all provisions of <br />the SAVE grant applies. <br />Approver initials: ________________ Date: ______________________ <br />Name: __________________________________________________ <br />Title: __________________________________________________ <br />31.90-DAY RETURN OF GRANT DOCUMENTS TO DBW <br />Grant agreements issued to the awarded agency must be completed and returned within 90 <br />days of the date of issuance according to the instructions issued by DBW with the grant <br />agreement. If extenuating circumstances prevent the ability of the agency to meet this <br />deadline, approval from DBW must be obtained in writing. DBW retains the right to determine <br />approval or denial of extensions. <br />32.ANTI-CORRUPTION <br />SAVE grantees are required to report to DBW any written, suggested, or verbally implied <br />cases whereby a contractor, subcontractor or other service provider increases their fee(s) due <br />to the existence of a Grantee’s SAVE grant, or inquires about the amount/balance of a SAVE <br />grant in order to increase their fee(s), for possible investigation of price gouging.
