<br />Consulting Services Agreement between City of San Leandro and 3/30/2022 <br />ARWS for R/W & Easements for MacArthur/Superior Roundabout <br />& Washington Avenue Reconstruction Exhibit A – Page 1 of 4 <br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />Introduction <br />There are two City projects associated with this contract. <br /> <br />MacArthur / Superior Roundabout Project <br />The City of San Leandro is proposing to construct a roundabout at the intersection of MacArthur Blvd / <br />Superior Ave / Foothill Blvd. The project will require right-of-way and temporary construction easements <br />from the private parcel located at 650 MacArthur Blvd, APN 076-0319-015-02. <br /> <br />Washington Avenue Reconstruction Project <br />This project will reconstruct Washington Avenue between West Juana Avenue and Castro Street. The <br />work will require two temporary construction easements (TCE) from the property located at 100 Pelton <br />Center Way, APN 077-0545-032-01, for the construction of two new curb ramps at the northeast and <br />southeast corners of the intersection of Washington Avenue and Pelton Center Way. <br /> <br /> MacArthur / Superior Roundabout Project <br /> <br />Scope of Work <br />Consultant shall prepare acquisition documents. Said documents include, but are not limited to: offer letter, <br />appraisal summary statement and summary of the basis for just compensation, summary statement <br />pertaining to the acquisition of real property or an interest therein, purchase agreement, deed, and public <br />acquisition brochure. Consultant will initiate and maintain an acquisition file. All acquisition documents to <br />receive the City’s written approval as to form prior to use in the field. <br /> <br />Consultant will negotiate to acquire a partial fee simple acquisition and temporary construction easement <br />from the subject property, which has one property owner and is leased for use as a liquor store. <br /> <br />CEQA and NEPA clearances shall be completed prior to initiation of negotiations. <br /> <br />All services to be provided pursuant to the Uniform Relocation Assistance and Real Property Acquisition <br />Policies Act and applicable state and federal laws, related guidelines and regulations. All discussions for <br />the acquisition of property or an interest therein will be directed to result in the payment of just <br />compensation. <br /> <br />Consultant will make every reasonable effort to acquire property on behalf of the City expeditiously through <br />agreement with its owner and to avoid litigation. This may necessitate greater levels of effort in the <br />negotiations phase and, where appropriate, should continue after eminent domain has been initiated. City <br />will provide ongoing feedback to Consultant as to authorization for settlements. <br /> <br />If an agreement with the property owner cannot be reached, Consultant will advise the City that <br />negotiations have reached an impasse.
