Yasaki, Esq. <br />405 14th Street, Suite 1215 <br />Oakland CA 94612 <br />Re: Washington Nursery Company <br />Dear Mr. Yasaki: <br />The purpose of this letter is to temorialize, our agreement <br />as to the intent and effect of the fo"!.owing paragraph contained <br />in a Grant of Easement for a storm dr:-_n to the City of San Leandro <br />dated January 11, 1978 and affecting i—sessor's Parcel No. <br />77B-1157-13-2: <br />"Washington Nursery Company res,.rves the right to <br />change the location of all or ;w y part of such ease- <br />ment if Washington Nursery Comp.iny should deem it nec- <br />essary or desirable, provided, `iowever, that all costs <br />of relocating such easement sh.i'_l be borne by Washington <br />Nursery Company and that the relocation shall not <br />diminish the efficiency of suc',. easement." <br />AS we discussed, and as concurred in by Mr. Fred Minnes, attorney <br />for Avansino-Mortensen, the paragraph empowers Washington Nursery <br />Company, if and when necessitated by cevelopment of the encumbered <br />property, to grant to the City of San Leandro an equivalent easement <br />in a different location in exchange for the vacation or quitclaim of <br />the City's interest in the subject easement.
