Resolution No. <br />Page Two <br />- I• RE.5375 R283 <br />1B=o82089 <br />BE IT FURTHER RESOLVED, that such conveyance shall be made upon the <br />following terms and conditions, to wit: <br />(a) There shall be no cost to Grantee for said right of way and easement. <br />(b) Grantee shall repair any and all damage to Grantor's property caused <br />by Grantee's use of said property and shall indemnify and hold Grantor <br />harmless from and against any and all cost, expense, loss, damage, <br />liability, claims or causes of action, liability for damages, injuries <br />to or death of any person, which shall in any way arise out of or <br />be connected with Grantee's use of said easement and right of way, <br />unless such damage, loss, injury or death shall be caused solely <br />by the negligence of Grantor. <br />(c) Prior to commencement of any work in said easement and right of way, <br />which includes maintenance and repair, the plans and specifications <br />for such work shall be approved by the Alameda County Flood Control <br />and 14ater Conservation District, provided further that the Grantee <br />shall not use said parcel of land, nor permit the same to be used, <br />for any purposes or in any manner which will interfere with the use <br />of the property for its primary purpose of flood control. <br />AND BE IT FURTHER RESOLVED, that the Chairman of this Board of Supervisors <br />be and he is hereby authorized and directed to execute, on behalf of the Alameda <br />County Flood Control and Water Conservation District, a Grant of Right of Way, <br />conveying unto the City of San Leandro, a municipal corporation, a perpetual right <br />of way and easement for oublic highway purposes, and incidents thereto, over, upon, <br />and across the hereinabove described real property; and <br />BE IT FURTHER RESOLVED, that the Director of Public Works be and he is <br />hereby authorized and directed to cause such executed document to be delivered to <br />the City of San Leandro for acceptance and recordation. <br />the foregoing is a corre :' <br />adopted by the <br />c; MAR �: 4 1979 <br />4i�' � A e — MAR 1 41978 <br />Zone 2, Line A <br />Extension of Springlake Drive <br />No. 6743 <br />
