I would <br />feel that the City certainly would be given a reasonable <br />amount of time to make the necessary appropriations <br />for such construction and a reasonable amount of time to <br />complete it. <br />4. I would feel that action by the City Counsel as the <br />legislative body of a municipal corporation should <br />expressly commit themselves to the acceptance of the <br />gift on the condition that tennis court(s) would be con- <br />structed by the City within a reasonable time. <br />In addition, I would feel that, pursuant to the wishes <br />of the testatrix, that the gift should be received by the <br />City in the names of Daniel M. and Henrietta A. Heath. <br />You will see this from a reading of the first paragraph of <br />the Will. <br />As I indicated to you, Lou Seeberger, the duly appointed <br />Administrator CTA, will be in the San Leandro area the <br />weekend of the 4th of July. I think that if at all <br />possible, it would be well to discuss the maintenance and <br />upkeep of this property with Mr. Seeberger. <br />The estate has one very realistic problem and that is <br />that specific bequests have been made of almost all the <br />known assets in the estate. Something or some portion of <br />these assets will have to be sold in order to provide for <br />the costs of administration and expenses of burial, etc. <br />I am presently looking into the legal implications that <br />this problem poses and you will be hearing from me in the <br />near future. <br />Very truly yours, <br />BRY H.
