Western Title Insurance Company <br />shall further be instructed to pay the remainder of said deposit <br />to Gary R. Rinehart Trustee for Jack B. Wood and Celia M. Wood <br />and Takeshi Endo and Takako Endo, upon the recordation of the <br />Final Order of Condemnation. <br />5. The payment of said sum and performance of said <br />work shall be in full payment for the real property or interest <br />in real property hereinabove described and for all damage of <br />every kind and nature accruing by reason of the acquisition of <br />(said property and the construction and maintenance thereon of the <br />public improvement as proposed by plaintiff, including interest <br />for plaintiff's possession prior to judgment and damages pursuant <br />to Code of Civil Procedure § 1263.510. <br />6. Upon payment of said total sum and performance of <br />said work, said real property shall be condemned to plaintiff and <br />s againt Jack B. Wood and Celia M. Wood, Takeshi Endo and Takako <br />, County of Alameda, Western Title Insurance Company, Mary <br />nd Baker and Eileen D. Pond Traverse, in fee simple absolute, <br />less a lesser estate is described, and all interests of said <br />efendants in and to said property shall be terminated. <br />7. The purpose for which said property is sought to be <br />ondemned is a public use authorized by law and that the taking <br />s necessary for such use. <br />8.
