Relinquishes to the City of San Leandro any and all rights Owner <br />may have to ingress to or egress from the above described land over and across <br />the line described as "parallel line, southeasterly, 42.98 feet", in the said <br />Deed to the City, to the public right-of-way commonly known as San Leandro <br />Boulevard. It is the purpose of this relinquishment that no right or easement <br />of access shall attach or be appurtenant to the property above described, by <br />reason of the fact that the same may abut upon a public right-of-way and/or a <br />City street; and <br />2. Further agrees to construct within 60 days of the date of execu- <br />tion of this document, a solid board fence or masonry wall, satisfactory in <br />design to the Director of Community Development, adjacent to the rear line of <br />the above described property. Owner shall maintain the side of said fence or <br />wall facing San Leandro Boulevard in a painted or stained condition so as to <br />present an attractive appearance. In the event Owner fails to comply with this <br />maintenance obligation, Owner grants to the City of San Leandro the right, after <br />the City's having provided Owner with City's intent to exercise such right, to <br />perform such construction and/or maintenance and to impose a special assessment <br />upon said property for the reasonable cost of such construction and/or main- <br />tenance. <br />In witness thereof, Owner has executed this Agreement For Relinquish- <br />ment Of Right Of Ingress And Egress and For Maintenance on the date hereinbelow <br />written. <br />DATE: February 27, 1985 <br />Owner, MaO C.
