<br />sion. is delivered or tendered to Buyer, or in event of rented property at close of escrow.
<br />4. Broker as a member of a multiple listing service is authorized to report the sale, price, terms and financing for the informa-
<br />tion, publication, and use of authorized multiple listing service members.
<br />5. This writing expresses the entire contract of the parties. There are no other understandings, oral or written, which in any
<br />manner alter or enlarge its terms, and Broker herein named shall not be held responsible for the failure of Buyer or Seller to comply
<br />with the terms of this contract.
<br />6. If legal action shall be brought by Buyer, Seller, or Broker arising out of this contract, the prevailing party shall be entitled
<br />to recover from the party not prevailing, the cost of suit and reasonable attorney's fees. If the only controversy between Buyer
<br />and Seller is as to the disposition of Buyer's deposit(s), such controversy at the election of both parties shall be decided by arbitration
<br />determined in accordance with the Rules of the American Arbitration Association, and judgment upon the award rendered by the
<br />arbitrator(s) may be entered in any court of competent jurisdiction. The provisions of Section 1283.05 of the California Code of Civil
<br />Procedure shall be applicable to such arbitration.
<br />7. The words "Buyer," "Seller," and "Broker" as used herein shall include the plural as well as the singular. Words used in
<br />masculine gender include the feminine and neuter.
<br />8. The paragraphs on the reverse side of this Real Property Purchase Contract and Deposit Receipt are incorporated into this
<br />contract as acknowledged by the respective parties immediately following said paragraphs.
<br />9. Time is of the essence of this contract. Any and all modifications or extensions for performance by either or both panties
<br />shall be in writing signed by both parties.
<br />10. If Seller shall fail to accept in writing the offer of Buyer herein contained within - --days, days, this offer shall be
<br />deemed revoked and the deposit(s) shall be returned to Buyer. Said acceptance by Seller shall be communicated to Buyer by deliver-
<br />ing a signed copy to Buyer, in person or by mail to Buyer's address below or by telegram or night letter to Buyer with a signed copy
<br />immediately mailed to Buyer's address below.
