GRANT DEED -1-2"0'. 5118 <br />EXHIBIT B <br />NATURE OF TENANTS <br />1. Intent. The Grantee, for itself and its successors and <br />assigns, represents and covenants to the Grantor that the initial <br />tenants and users of space in the Redeveloper Parcels shall be a <br />Safeway -type of retail food store and a super -drug store. Without <br />limitation of the foregoing, Grantee shall have the right, in the <br />event of a termination of either the Safeway or Bill's Drugs' leases, <br />or both, to change the use of Redeveloper Parcels or any portion <br />thereof to any use consistent with the objectives of this Agreement, <br />and permitted by the Redevelopment Plan, provided, however, that such <br />right shall include, but not be limited to, the right, subject to <br />Grantor review and approval as herein elsewhere provided, to lease to <br />smaller retail tenants by modifying or altering existing building <br />structures to create retail space. The parties agree that retail <br />tenants shall offer primarily apparel, food, liquor, general software, <br />gifts and similar merchandise and may include restaurants and <br />financial institutions, but shall not include, without specific <br />Grantor approval, personal service shops, business or commercial <br />offices, schools or training facilities, launderettes, dry cleaners or <br />other neighborhood service facilities, or the sale of used <br />merchandise. Nothing in this section shall restrict the ability of <br />any tenant to discount the price of any service or merchandise.The <br />Agency is relying upon such representations and covenants in entering <br />into this Agreement, and shall have the right to exercise review and <br />approval of tenants and uses on the Redeveloper Parcels pursuant to <br />any powers that may be conferred upon the Agency pursuant hereto. <br />2. Grantor Approval. Grantee agrees for itself, successors and <br />assigns that the identities of proposed initial tenants of commercial <br />areas designated in the Master Site Plan shall be submitted to <br />Grantor's Executive Director on a confidential basis, for his approval <br />prior to final execution of leases with said tenants. In addition, <br />Grantee (or its successors or assigns as the case may be) shall submit <br />such other information regarding the nature of the business to be <br />carried out under the lease as may be reasonably required by the <br />Grantor's Executive Director or his designee to exercise his approval <br />pursuant to this Exhibit. <br />Within seven ( 7 ) days of receipt of the identity of the <br />proposed initial tenant and such other information as is required by <br />the Grantor's Executive Director or his designee, Grantor's Executive <br />Director or his designee shall either approve or reject the tenant. A <br />rejection shall be in writing and shall set forth the reasons <br />therefor. If not approved or rejected within the time set forth <br />herein, the tenant shall be deemed approved.
