19-0438.52 1431 RESOLUTION NO. i (Sale of Parcel #2, a Part of Kennedy School site,to San Leandro) WHEREAS, the described real property belonging to the San Leandro Unified School District of Alameda County, State of California, public corporation, will not at the time of delivery of title or possession as hereinafter provided, be -needed for school classroom buildings by said School District, to wit, all that real property in the City of San Leandro, County of Alameda, State.of California, popularly known as a part of the Kennedy School site, more particularly described in Exhibit A attached hereto and by this reference incorporated herein; and I:THE'F.iAS, a Negative Declaration has been prepared and filed .in accordance with Public Resources Code Sections 21000, et seq.; and WHEREAS, the hereinbelow described sale has been approved by the San Leandro Planning Commission pursuant to Government Code Section 65402(c); NOW, THEREFORE, BE IT -RESOLVED that pursuant to the provisions of Sections 39500 to 39502, inclusive, of the Education Code of the State of California, title and fee to the real property hereinabOve described shall be granted and conveyed to the City of San Leandro, a municipal corporation of the State of California, subject to any and all unpaid taxes, assessments, easements, rights of way, restrictions, reservations, covenants, conditions, deeds of trust, mortgages, liens, applicable laws and ordinances, redevelopment plans and proceedings, defects of title and any encumbrances thereon of any nature or kind whatsoever, in consideration of the City of San Leandro paying to the San Leandro Unified School District the amount of $68,759.00 and in consideration of the benefits which will accrue to this School District from the maintenance of said real property by the City of San Leandro; and - 1 - p /z /-o36 AOV te4 yam, - q
