paragraphs 1 and 2, said real property shall be condemned to <br />c <br />Plaintiff and as against EDWARD SCARES; ELLSWORTH SOARES; the <br />3 heirs and devisees of RAYMOND SCARES, deceased, and all persons <br />claiming by, through, or under said decedent; the heirs and <br />devisees of LEONARD SCARES, deceased, and all persons claiming <br />6 by, through, or under said decedent; and WILLIAM SCARES, in fee <br />7 <br />simple absolute, unless a lesser estate is described, and all <br />8 interests of said defendants in and to said property shall be <br />Q terminated. <br />10 7. The purpose for which said property is sought to <br />ill be condemned is a public use authorized by law and that the taking <br />12 <br />is necessary for such use. <br />13 8. Possession having been taken by Plaintiff on August <br />14 4, 1988, pursuant to an Order for Possession, all taxes, penalties <br />15 and costs which are a lien on said property and which are <br />16 apportioned to that portion of the fiscal year after such date <br />17 (the "date of apportionment") are hereby cancelled pursuant to <br />18 Revenue and Taxation Code § 4986. All such taxes, penalties and <br />19 costs apportioned to that portion of the fiscal year before the <br />20 "date of apportionment", which shall be unpaid, if any, shall be <br />21 deducted from the sum of $20,000 and paid to the County of <br />Alameda. <br />22 <br />23 9. The Plaintiff shall bear its costs of suit, if any. <br />24 10. The Plaintiff shall pay all escrow costs and costs <br />25 of title insurance, if any. <br />26 <br />27 <br />\IEYERS.
