IN THE CITY COUNCIL <br />THE CITY OF SAN LEANDRO <br />FINDINGS OF FACT <br />RELOCATION ASSISTANCE APPEAL HEARING <br />BONNIE PENNINGTON - 1234 ORCHARD AVENUE <br />THRASHER PARK MASTER PLAN <br />The matter of the appeal for an increase in a relocation assistance <br />payment was heard by the City Council on Tuesday, February 19, 1991, at a <br />formal hearing. After due consideration of all public testimony and the staff <br />report, the Council makes the following Findings of Fact, and determines that <br />each of them is true. <br />I <br />The City has purchased real property at 1234 Orchard Avenue for fair <br />market value. It was purchased to complete the expansion of Thrasher Park as <br />specified under the Thrasher Park Master Plan. <br />II <br />Alameda County Public Works Agency Real Estate Office, a certified <br />agency by the State of California, represented the City of San Leandro for a <br />fair assessment of Mrs. Pennington's relocation assistance. Mrs. Pennington <br />owned the property at 1234 Orchard Avenue. <br />III <br />Mrs. Pennington and her real estate agent, Dan Ryan, testified to <br />increase her replacement housing payment because she believes a replacement <br />house cannot be purchased under her present Last Resort Housing Plan prepared <br />by Alameda County. <br />IV <br />Based on the testimony by Dan Ryan and the facts presented by John <br />Fenstermacher of Alameda County, the Council upheld the staff report and did <br />not increase Mrs. Pennington's replacement housing payment. <br />ACTION <br />The City Council denied the relocation assistance appeal from Mrs. <br />Bonnie Pennington, and believes the data contained in the Last Resort Housing <br />Plan No. 89-5-1, prepared by Alameda County, is a fair assessment of her <br />relocation assistance as prescribed under the amended (1989) Uniform <br />Relocation Assistance and Real Property Acquisition Policies Act of 1970. <br />CITY OF S LEANDRO <br />YftfARP, Major <br />City Council, San Leandro, California <br />Attest: <br />ALICE CALVERT, City Clerk <br />D:\COUNCIL\0304\PENNING\PENNING.FND <br />
