2.24.010 <br />Chapter 2.24 <br />LOW AND MODERATE INCOME <br />HOUSING <br />Sections: <br />2.24.010 <br />Definition of terms. <br />2.24.020 <br />Authority generally. <br />2.24.030 <br />Replacement housing. <br />2.24.040 <br />New or rehabilitated <br />dwelling units developed <br />within the project area. <br />2.24.050 <br />Duration of dwelling unit <br />availability. <br />2.24.060 <br />Relocation housing. <br />2.24.070 <br />Tax increment funds. <br />2.24.010 Definition of terms. <br />The terms "affordable rent," "replacement <br />dwelling unit," "persons and families of low <br />or moderate income" and "very low income <br />households" as used herein shall have the <br />meanings as defined by the Community <br />Redevelopment Law, and other state and local <br />laws and regulations pertaining thereto as <br />amended from time to time. (Ord. 93-012 § <br />431, 1993) <br />2.24.020 Authority generally. <br />The agency may, inside the incorporated <br />sections of project area or the city, acquire <br />land, donate land, improve sites, construct or <br />rehabilitate structures, and undertake other <br />activities authorized by the Redevelopment <br />Law to provide or rehabilitate housing for <br />persons and families or low or moderate <br />income, and may, in the unincorporated <br />portion of the project area, finance the cost of <br />the above -described activities to be approved <br />and implemented by the county. (Ord. 93-012 <br />§ 432, 1993) <br />2.24.030 Replacement housing. <br />To the extent required by Health and Safety <br />Code Sections 33413 and 33413.5, whenever <br />dwelling units housing persons and families of <br />low or moderate income are destroyed or <br />removed from the low and moderate income <br />housing market as part off a redevelopment <br />project which is subject to a written agreement <br />with the agency or where financial assistance <br />has been provided by the agency, the agency <br />shall, within four years of such destruction or <br />removal, rehabilitate, develop or construct, or <br />cause to be rehabilitated, developed or <br />constructed for rental or sale to persons and <br />families or low or moderate income an equal <br />number of replacement dwelling units at <br />affordable housing costs as defined by Section <br />50052.5 of the Health and Safety Code, within <br />the territorial jurisdiction of the agency. <br />Seventy-five percent (75%) of the replace- <br />ment dwelling units shall replace dwelling <br />units available at affordable housing costs to <br />the same income level of very low income <br />households, lower income households and <br />persons and families of low and moderate <br />income as the persons displaced from those <br />destroyed or removed units. (Ord. 93-012 § <br />433, 1993) <br />2.24.040 New or rehabilitated <br />dwelling units developed <br />within the project area. <br />While the housing programs to be <br />implemented in the project area will <br />emphasize rehabilitation and home ownership <br />assistance as a priority, state law requires the <br />following standards for the project: <br />76 <br />
