93070979 <br />1 dencs_ted the sum of ONE HUNDRED TWELVE 'THOUSAND FOUR HUNDRED <br />2 DOLLPRS ($112,400.00) into the State Treasury Condemnation Fund, <br />3 said sum representing the agreed -upon just comnensation. <br />4 NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED <br />5 that Defendants .LUCKY STORES, INC., a Delaware corporation, <br />6 successor by merger to Lucky Stores, Inc., a California <br />7 corporation, and doing business as Delaware Lucky Stores, Inc. <br />8 and WFLLNUT CREEK CANNING CO. ("Defendant LUCK'i STORES") has <br />9 withdrawn the above -referenced sum from the State Treasury <br />10 Condemnation Fund per this Court's Order of Withdrawal, a true <br />11 and ccrrect copy of which is attached hereto as Exhibit "2." <br />12 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that <br />13 Plaintiff CITY OF SRN LEANDRO shall nav to Defendant LUCKY <br />14 STORES the sum of interest from June 8, 1-992, through December <br />15 30, 1992, as provided by law, on the above referenced <br />16 $112,400.00, within 30 days of the date hereof, and that the <br />17 above -referenced $112,400.00 plus such interest represent the <br />18 full, adequate and just compensation for the taking of the <br />19 properties more particularly described in Exhibits "3-A," 113-3" <br />20 and 113-C" (the "subject properties"), attached hereto and <br />21 incorporated herein. <br />22 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the <br />23 fee simple title in and to the subject properties will vest in <br />24 Plain-iff free and discharged of all claims and liens of every <br />25 kind whatsoever, except utility easements of record, forthwith <br />26 upon reccrdaticn of this final judgment; <br />27 iT IS FURTHER ORDERED; ADJUDGED AND 'DECREED that: <br />t'IEYERS, NAVE, Z8 <br />RIBACK & SILVER <br />A PROFESSIONAL LAW COR OAATION <br />GATEWAY PLAZA <br />-77 DAVIS STREET.
