93070979 1 dencs_ted the sum of ONE HUNDRED TWELVE 'THOUSAND FOUR HUNDRED 2 DOLLPRS ($112,400.00) into the State Treasury Condemnation Fund, 3 said sum representing the agreed -upon just comnensation. 4 NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED 5 that Defendants .LUCKY STORES, INC., a Delaware corporation, 6 successor by merger to Lucky Stores, Inc., a California 7 corporation, and doing business as Delaware Lucky Stores, Inc. 8 and WFLLNUT CREEK CANNING CO. ("Defendant LUCK'i STORES") has 9 withdrawn the above -referenced sum from the State Treasury 10 Condemnation Fund per this Court's Order of Withdrawal, a true 11 and ccrrect copy of which is attached hereto as Exhibit "2." 12 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that 13 Plaintiff CITY OF SRN LEANDRO shall nav to Defendant LUCKY 14 STORES the sum of interest from June 8, 1-992, through December 15 30, 1992, as provided by law, on the above referenced 16 $112,400.00, within 30 days of the date hereof, and that the 17 above -referenced $112,400.00 plus such interest represent the 18 full, adequate and just compensation for the taking of the 19 properties more particularly described in Exhibits "3-A," 113-3" 20 and 113-C" (the "subject properties"), attached hereto and 21 incorporated herein. 22 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the 23 fee simple title in and to the subject properties will vest in 24 Plain-iff free and discharged of all claims and liens of every 25 kind whatsoever, except utility easements of record, forthwith 26 upon reccrdaticn of this final judgment; 27 iT IS FURTHER ORDERED; ADJUDGED AND 'DECREED that: t'IEYERS, NAVE, Z8 RIBACK & SILVER A PROFESSIONAL LAW COR OAATION GATEWAY PLAZA -77 DAVIS STREET.
