(collectively, <br />"Lucky Stores") for withdrawal of deposit of probable <br />=ompensation came on regularly for hearing at the above -date <br />and time. <br />Upon consideration of the papers and filings presented <br />to the Court, and good cause appearing therefor, this Court <br />hereby grants Lucky Stores' motion and verified application <br />for withdrawal of probable compensation pursuant to C.C.P. <br />§ 1255.220. Accordingly, <br />IT IS HEREBY ORDERED that the person or entity in posses- <br />sion of the deposit of probable compensation in this matter <br />be, and hereby is, directed to immediately issue a check pay- <br />able to "Lucky Stores, Inc. and Walnut Creek Canning Co." in <br />the amount of $112,400.00, or otherwise immediately transfer <br />said sum to Lucky Stores. <br />IT IS HEREBY FURTHER ORDERED that plaintiff City of San <br />Leandro ("the City") be, and hereby is, directed to promptly <br />pay to Lucky Stores the amount of interest accrued on the <br />deposit filed with the State Controller as Receipt No. 34749 <br />PROPOSED ORDER GRANTING MOTION & APPLIC.
