1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />it <br />M <br />NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED that the total <br />just compensation to be paid by the CITY to Defendant INSURED TRANSPORTERS, INC. <br />("INSURED") for the acquisition of the real property described in Exhibit A, attached <br />hereto, is the sum of FOUR HUNDRED SIXTY-THREE THOUSAND SIX HUNDRED <br />FIFTY-FOUR and 02/100 DOLLARS ($463,654.02), inclusive of statutory interest and <br />I costs. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the total just <br />compensation to be paid by CITY to Defendant MV TRANSPORTATION ("MV") for any <br />and all claims it may have arising from the acquisition of the real property described in <br />Exhibit A, attached hereto, including, but not limited to, loss of business goodwill and <br />relocation expenses, is the sum of FIFTY THOUSAND DOLLARS and 00/100 DOLLARS <br />($50,000.00), inclusive of statutory interest and costs. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that payment of the <br />total sum FIVE HUNDRED THIRTEEN THOUSAND SIX HUNDRED FIFTY FOUR and <br />02/100 DOLLARS ($513,654.02) has been made to INSURED and MV, and therefore, fee <br />simple title shall be condemned to Plaintiff CITY OF SAN LEANDRO and as against <br />INSURED. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the payment of sai <br />sum shall constitute full payment for said fee simple title and for all damages of every kind <br />and nature accruing by reason of the acquisition of said real property, including, but not <br />limited to loss of business goodwill, relocation expenses, and the construction and <br />maintenance thereon of the public improvements as proposed by Plaintiff. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the public use and <br />necessity require the project for which said real property is acquired, that the said project i <br />planned and located in the manner that will be most compatible with the greatest public <br />good and the least private injury, that the said real property is necessary for the said <br />project, and that the purpose for which said property is acquired, for purposes of <br />Final Order of Condemnation <br />784395 <br />
