SECTION 17. RECORDATION OF REGULATORY AGREEMENT <br />The Developer shall cause this Regulatory Agreement and all amendments and supplements <br />hereto to be recorded in the land records of the Agency, and in such other places as the Agency may <br />reasonably request, including the County of Alameda. <br />SECTION 19. SUCCESSORS BOUND <br />This Regulatory Agreement and the covenants and conditions contained herein shall run with the <br />land and shall bind, and the benefits shall inure to, respectively, the Developer and its successors and <br />assigns and all subsequent Developers of the Project or any interest herein, and the Agency and its <br />successors and assigns. <br />SECTION 20. SEVERABILITY <br />The invalidity of any clause, part or provision of this Regulatory Agreement shall not affect the <br />validity of the remaining portions thereof. Nothing in this Regulatory Agreement shall prevent the Agency <br />from exercising any of their rights under the Deed of Trust. <br />SECTION 22. GOVERNING LAW <br />This Regulatory Agreement shall be construed in accordance with the laws of the State of <br />California. <br />SECTION 23. AMENDMENTS <br />Except as otherwise provided hereunder, this Regulatory Agreement may not be amended, <br />changed, modified, altered or terminated except as permitted in this Agreement. This Regulatory <br />Agreement shall be amended only by a written instrument executed by the Parties hereto or their <br />successors in title, and duly recorded in the real property records of the County of Alameda, California. <br />8 <br />
