3.08.050 <br />owner fails or refuses to agree to participate in <br />redevelopment by executing participation <br />agreement. <br />The agency shall not acquire, without the <br />owner's consent, property to be retained pur- <br />suant to a participation agreement, so long as <br />the owner fully performs the agreement. (Ord. <br />99-025 § 206, 1999) <br />3.08.050 Property management. <br />Property owned by the agency shall be un- <br />der the agency's management and control. <br />The agency may rent or lease such property <br />pending its disposition for redevelopment and <br />may adopt property management policies. <br />(Ord. 99-025 § 207, 1999) <br />3.08.060 Building permits. <br />The agency is authorized to establish build- <br />ing permit application procedures in addition <br />to those generally required by the city. The <br />city shall issue a building permit only after the <br />applicant has obtained the necessary approvals <br />from the agency and has demonstrated com- <br />pliance with the provisions of the plan, any <br />design guide adopted by the agency, any re- <br />strictions or controls established by the <br />agency, and any applicable agreement. <br />The city shall not issue any building permit <br />in the project area for the construction of any <br />new structure or any addition, construction, <br />moving, conversion or alteration to an existing <br />structure, or preparation of any site, or the <br />installation of any physical improvement, in- <br />cluding grading and landscaping, until the <br />applicant has complied with all pertinent pro- <br />cedures established by the agency. (Ord. 99- <br />025 § 310, 1999) <br />3.08.070 Planning commission <br />review. <br />A. If the redevelopment advisory commit- <br />tee or its successor body (if any) so directs, <br />the following projects shall be submitted to <br />the planning commission for review and rec- <br />ommendation prior to submittal to the rede- <br />velopment agency. The commission shall re- <br />port its findings and recommendations to the <br />agency prior to the agency's consideration of <br />the project. <br />1. Any design guidelines proposals sub- <br />mitted to the agency for adoption; <br />2. Any project that would necessitate a <br />change in land use designation or zoning; <br />3. Streetscape master plans; <br />4. Any land use plans for identifiable <br />multi -parcel areas within the project area, in- <br />cluding specific plans or master plans; <br />5. Any plans for new development on <br />sites larger than two acres in the West San <br />Leandro sub -area or larger than one-half acre <br />in the MacArthur Boulevard sub -area; <br />6. Any project for which an environment <br />impact report is required to be prepared pur- <br />suant to the California Environmental Quality <br />Act. <br />B. This section shall not apply to any pro- <br />jects reviewed by the board of zoning adjust- <br />ments pursuant to the San Leandro zoning <br />code. (Ord. 99-025 § 311, 1999) <br />3.08.080 Actions by the city. <br />A. Upon the agency's request, the city <br />shall aid and cooperate with the agency in im- <br />plementin�g the plan and shall take all actions <br />necessary to ensure the continued fulfillment <br />of the purposes of the plan and to prevent the <br />recurrence or spread in the project area of <br />conditions causing blight.
