described in Exhibit B which is attached hereto and incorporated <br />herein. Said crossing will be numbered D-14.96. The application <br />shall include the Company's recommendation that two Standard CPUC No. <br />9A warning devices be provided at the proposed crossing. The <br />application will further provide that the CPUC order the Company to <br />maintain the required crossing protection devices, and that the City's <br />share of the maintenance costs assigned by the CPUC be limited to <br />funds allotted by the Commission pursuant to § 1231.1 of the Public <br />Utilities Code. The City will by separate request apply to the CPUC <br />for permission to improve the Davis Street crossing D-14.7 under terms <br />of General Order SSA. <br />4. The Company shall convey to the City by grant deed or deeds <br />any and all interests which it holds in Parcels 1, 2, 3 and 4. Said <br />parcels shall be held and used for public right-of-way purposes. City <br />shall, at its sole cost and expense, remove all improvements including <br />rails, ties, ballast and switches from the property conveyed by the <br />Company. <br />5. The Company shall assign to City all leases, licenses track <br />agreements affecting the real property to be conveyed to the City in <br />accordance with Paragraph 4. <br />6.
