IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2000- 167 (1049/1-337) <br />RESOLUTION ACCEPTING THE TRANSFER OF RIGHT-OF-WAY OF EMBERS WAY <br />BETWEEN LEWELLING BOULEVARD AND HESPERIAN BOULEVARD <br />FROM THE STATE DEPARTMENT OF TRANSPORTATION (CALTRANS) <br />WHEREAS, on March 11. 1986, Caltrans and Alameda County signed the Freeway <br />Agreement regarding, the Freeway I-238 and I-880 Interchange construction; and <br />WHEREAS, Embers Way and a portion of Lewelling Boulevard are a part of the right- <br />of-way covered by the agreement, and, as a result of this Interchange, the State no longer needs <br />Embers Way and per the agreement is willing to relinquish the right-of-way; and <br />WHEREAS, Caltrans staff has prepared a map (Exhibit A) that shows the area of <br />relinquishment; and <br />WHEREAS, Upon transfer, the City would have to maintain the road. as it will become <br />part of the City of San Leandro street network; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San <br />Leandro hereby accepts the transfer of right-of-way of Embers Way between Lewelling <br />Boulevard and Hesperian Boulevard from the State Department of Transportation (Caltrans). <br />BE IT FURTHER RESOLVED, that the City Council waives the 90-day Notice of <br />Intention to relinquish this right-of-way to the City. <br />
