AGREEMENT TO TERMINATE LEASE, <br />ASSIGN RIGHTS, AND QUITCLAIM <br />THIS AGREEMENT ("Agreement") is between the City of San Leandro <br />("City") and Willliam E. Peluso and Vernice A. Peluso as Trustees of the William E. <br />Peluso and Vernice A. Peluso 1990 Revocable Living Trust ("Peluso"), and is dated <br />for the convenience of the parties this 23rd day of August, 1995. <br />RECITALS <br />A. City and Peluso are parties to a lease ("Lease") dated October 26, 1964, <br />a copy of which is on file in the office of the City Clerk of the City, affecting the <br />following described premises in the City of San Leandro, County of Alameda, State of <br />California, to wit: <br />Commencing at the most westerly concrete monument in <br />Marina Boulevard, formerly First Avenue, as shown on the <br />Map of Mulford Gardens Addition, filed February 1, 1928, <br />in Book 7 of Maps at page 55, Alameda County Records, <br />said monument having grid coordinates of X = 1,511, <br />500.65 and Y = 441, 678.36 based on the California <br />Coordinate System, Zone 3; (the bearing of Marina <br />Boulevard being taken as north 630 18' 39" east for the <br />purpose of this description) thence south 45' 13' 41" west <br />1,378.02 feet to a point having grid coordinates of X = <br />1,510, 522.37 and Y = 440, 707.84, said point being the <br />true point of beginning; thence south 5 ° 00' 00" east <br />105.00 feet; thence south 62° 59' 59" west 198.32 feet; <br />more or less, to the back edge of an existing sidewalk; <br />thence along the back edge of said existing sidewalk the <br />three following courses and distances: north 350 30' 00" <br />west 25.00 feet; south 570 00' 00" west 18.00 feet; and <br />north 20 30' 00" west 43.00 feet; thence departing from <br />the back edge of said existing sidewalk north 30' 34' 21" <br />Agreement to Terminate Lease, <br />Assign Rights and Quitclaim <br />1 <br />
