A <br />90147560 <br />I. <br />1 <br />2 That a Complaint was filed on January 25, 1990, seeking to <br />3 condemn the parcel of land described in Exhibit "A", attached <br />4 hereto and incorporated herein, for the purpose of widening <br />5 <br />Marina Boulevard. <br />II. <br />6 <br />7 That said property, together with all claimants and <br />8 property owners interested therein, is within the jurisdiction <br />9 of this Court which has the power and authority to enter this <br />10 Interlocutory Judgment. <br />11 III. <br />12 That at the time of and immediately prior to the <br />13 commencement of this action, Defendant KAISER COMMUNITY HOMES <br />14 was the fee simple owner of the parcel described in Exhibit <br />15 "A". Following publication of Summons, the default of <br />16 Defendant KAISER COMMUNITY HOMES was entered by the Clerk of <br />17 the Court on April 9, 1990. <br />IV. <br />18 <br />19 That each and all of the facts stated in said Complaint as <br />20 to said Defendant and the parcel described in Exhibit "A" are <br />21 true, and that the parcel is situated in the County of Alameda <br />22 and is more particularly described in Exhibit "A". <br />23 NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED <br />24 that on payment of the total sum of $3,400.00, which was <br />25 deposited with the State Treasury Condemnation Fund on January <br />26 24, 1990, the real property described in Plaintiff's Complaint <br />27 on file herein shall be condemned for the purpose of widening <br />,8 Marina Boulevard. <br />- <br />_l <br />-CCN.'WAR 2 <br />36\PLEAD\61\INJUD <br />
