? 3 �43 <br />1 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Plaintiff <br />2 CITY OF SAN LEANDRO, on May 3, 1993, paid to Defendant SOUTHERN <br />3 PACIFIC TRANSPORTATION COMPANY the sum of FOUR THOUSAND DOLLARS <br />4 ($4,000.00) and that said sum, together with the above- <br />5 referenced deposit, represents the full, adequate and just <br />6 compensation for the taking of the property more particularly <br />7 described in Exhibits 3-A and 3-B (the "subject property"), <br />8 attached hereto and incorporated herein; <br />9 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the fee <br />10 simple title in and to the subject property will vest in <br />it Plaintiff free and discharged of all claims and liens of every <br />12 ind whatsoever forthwith upon recordation of this final <br />13 Judgment; <br />14 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that: <br />15 (a) The public interest and necessity require the <br />16 project; <br />17 (b) The acquisition is planned and located in the <br />18 manner that will be most compatible with the greatest <br />19 public good and to the least private injury; and <br />20 (c) The property sought to be acquired is necessary <br />21 for the construction of the Teagarden Street Extension; <br />22 IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the real <br />23 property taxes, including any delinquencies, costs and interest, <br />24 if any, shall be apportioned and prorated in accordance with <br />25 Revenue and Taxation Code Section 5082 as of September 13, 1992, <br />26 and such portion of said taxes as is attributable to the period <br />27 from and after said date be and the same is hereby canceled, and <br />28 <br />cs1\136\p1ead\124\fina1.jug <br />7 <br />
